Seeking Lawyer to Provide Image/Likeness Opinion Memo
Anonymous
Our company is developing NFTs that currently take Spotify images, manipulate them, and product an altered version of the original image. Before making the project go live, we need to be sure that we will not encounter (or at least have a strong legal argument against) in lawsuits related to celebrity image / likeness.
The deliverable of this opportunity is the following:
1. Under the laws of Delaware (in which our company is registered), is it legal (based on image / likeness laws) to take a pre-existing image of a celebrity and or a celebrity's album cover, manipulate said image, and sell the output as an original work?
2. Under the laws of Delaware (in which our company is registered), is it legal (based on image / likeness laws) to make an illustration of a celebrity and or a celebrity's album cover and sell the output as an original work?
Both opinions must be drafted in a short memo. An example of what our NFT currently looks like (more specifically, one of them) is attached to this post.
